INTRODUCTION:

PATENTS are the legal expression for the celebration of innovation and creation in the industrial field. It gives the patent owner and exclusive right to use his invention for a period of 20 years without facing any kind of competition in the market. The patent system protects your invention so that you can use it to build a strong and solid business in the market.

The patent systems are territorial all over the world. That means you get protection only in the state you are applying for. However, in case you wish to apply for multiple states (for example if you were conducting your business both in Egypt and the GCC region), you shall apply to the PCT system. The legal formalities of the patent system are rigorous and tightly coupled with time limits.

REQUIREMENTS:

Filing Patent Applications:

  1. A power of attorney duly legalized from the Egyptian Consulate.
  2. A deed of assignment duly legalized from the Egyptian Consulate.
  3. The name, address, nationality, and profession or nature of business of the applicant(s) and the inventor(s).
  4. The specification in English or French for preparing the Arabic translation. The specification must be subdivided as follows:
       a.Prior art,b. Drawbacks of the prior art,
       b. What is new about the invention (improvements),
       c. Detailed description,
       c. Mode of exploitation of the invention,
       d. Claims of the invention.
  5. A summary of the invention (abstract) in English and Arabic (about 100 words).
  6. One set of formal engineering drawings.
  7. The commercial register, or a copy of the certificate of incorporation. The document in either form should be duly legalized up to the Egyptian Consulate.
  8. A certified copy of the priority document must be submitted within three months, in case it is claimed.

Notes:
Items 1, 2, and 7 must be available within 4 months from the filing date; otherwise, the application will lapse irrevocably, and the specification in English or French must be filed with the application. The Arabic translation must be submitted within 6 months. 

Assignment Applications:

  1. A power of attorney signed by the assignee and duly legalized from the Egyptian Consulate.
  2. An extract of the entry of the assignee company in the commercial register or a certified copy of the certificate of incorporation legalized from the Egyptian Consulate.
  3. A duly legalized deed of assignment from the assignor(s) to the assignee(s).
Change of Name/Address Applications:

  1. A power of attorney duly legalized from the Egyptian Consulate.
  2. the change of name and/or address certificate duly legalized from the Egyptian Consulate.

License Applications:

  1. A license agreement duly legalized from the Egyptian Consulate.
  2. An extract of the entry of the licensee company in the commercial register or a copy of the certificate of incorporation duly legalized from the Egyptian Consulate.
